City Council Meeting – September 14, 2009

1.  Call to Order, Prayer, Pledge of Allegiance

2.   Adjustment & Approval of September Agenda:  Items will only be added or removed upon approval of the Mayor and City Council.

3.   Special Presentations:

A)  Special Award to Hannah Baldwin: Page___________ Mayor Hovis will present Hannah Baldwin, Miss Gastonia’s Outstanding Teen 2010, with a special award from the City.  Hannah is the 13 year old daughter of John and Jeanie Baldwin of Bessemer City.  She will represent our area in North Carolina’s Outstanding Teen Pageant that will be held next June in Raleigh.

B)  A Proclamation – Constitution Week:  Page___________ Mayor Hovis will read a proclamation proclaiming the week of September 13-19, 2009 as Constitution Week.

4.   Approval of Minutes:  Special Meeting of August 10, 2009 – Page__________

5.   Requests to Speak/Opportunity for Public Comment:  This is an opportunity for members of the public to express items of interest to the Mayor and City Council.  This is not a time to respond or take action.  Any necessary action will be taken under advisement.  Speakers are required to use proper decorum and asked to limit comments to no more than five minutes.

A)  Ms. LaVerne Partlow, Education Coordinator/Gaston County Health Department:  Page_________ Ms. Partlow has requested to speak regarding obesity in Gaston County.  A resolution is enclosed for your consideration following her presentation.

B)  Other

6.   Consent Agenda:  The items of the “Consent Agenda” are adopted on a single motion and vote, unless the Mayor or Council wishes to withdraw an item for separate vote and/or discussion.

A)  Overnight Travel Request:  Page__________ The City Planner requests approval to attend the 2009 North Carolina APA Conference, September 30 – October 2.

B) Demolition Ordinance for S. Mickley Avenue (Tax Parcel #122522):  Page___________ The property is owned by Gwendolyn Smith and has been vacant for so long that it does not have an assigned address number, nor does it have a water meter.  A full account of actions taken by Code Enforcement is enclosed for your review.

7.   Cleveland County Water Impoundment Presentation:  Kings Mountain Mayor, Rick Murphrey and representatives of HDR Consultants will make a presentation regarding plans for the Cleveland County water impoundment.

8.   Dr. Glenn Kiser’s Unitrust Funds:  Page_________ Dr. Glenn Kiser established a Unitrust in 1992 with Wachovia Bank.  One-half of the trust would be a gift to the City of Bessemer City upon the deaths of both Dr. Kiser and his wife.   As you know they are both deceased and the City has received its share of the trust.   The Recreation Director will be present to speak regarding use of these funds.

9.   Solicitors/Peddlers Ordinance: Page________ This item was discussed at the August meeting with the consensus being that restrictive guidelines should be developed; however, it was not Council’s desire to restrict the sale of Girl Scout cookies, school projects, etc.  City Planner, Kevin Krouse has researched a number of ordinances and finds that Davidson, North Carolina has one that seems to fit.  The ordinance is attached for consideration and can definitely be tailored to Bessemer City.

11.  Discussion of “Open Items”:  Mayor Hovis asked, at the August meeting, that this item be placed on all regular agendas.

12.  Council General Discussion:  This is an opportunity for the Mayor and City Council to ask questions for clarification, provide information to staff, request staff to report back on a matter, or direct staff to place a matter on a future agenda.
